These Terms of Service (the “Terms”) govern your access to and use of CreativeRealtor.ca (the “Service”), a website-building and hosting platform for licensed real estate professionals, owned and operated by MyGTA Inc. (“MyGTA”, “we”, “us”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and — if you display listing data — the MLS®/DDF®/VOW Data Authorization Agreement, all of which are incorporated into these Terms by reference. If you do not agree, do not use the Service.
1. Eligibility
The Service is intended for licensed real estate professionals in Canada. To create an account you must be at least 18 years old, hold a valid real estate registration (for Ontario, a RECO registration), and provide accurate, current and complete information — including a license number that belongs to you. We may suspend or terminate accounts created with false, borrowed or expired license information.
2. Your account
You are responsible for safeguarding your password and for all activity under your account. One account per person; accounts may not be shared, sold or transferred. Notify us promptly of any unauthorized use of your account. We may require verification of your identity or licensing status at any time.
3. The Service
The Service lets you create, customize, publish and host real estate websites, including AI-assisted content generation, property search, mapping, and — using credentials and authorizations that you supply — display of MLS® listing data. We may add, change or remove features at any time. We strive for high availability but do not guarantee uninterrupted operation.
4. Plans, trials and billing
Certain features require a paid plan. Prices, plan limits and included features are described in the Service and may change with reasonable notice. Trials convert or expire as described at signup. Payments are processed by our payment provider (currently Stripe); by subscribing you authorize recurring charges until you cancel. Fees are in Canadian dollars unless stated otherwise and are exclusive of applicable taxes. You may cancel at any time, effective at the end of the current billing period; except where required by law, fees already paid are non-refundable.
5. Your content
You retain ownership of the content you upload or create on the Service (text, images, branding, and your site configuration). You grant MyGTA a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute that content solely to operate and provide the Service. You are solely responsible for your content, including its accuracy and its compliance with advertising rules that apply to you (including RECO/TRESA advertising requirements and your brokerage's policies).
6. AI-generated content
The Service can generate content (such as biographies and taglines) from information you provide, including your public social profiles. AI-generated content may contain errors. You must review and approve all generated content before publishing it, and you are solely responsible for what you publish.
7. MLS®, DDF® and VOW data
MyGTA is a technology provider only. We do not hold MLS® membership and we do not supply listing data. Any listing data displayed through your site is retrieved using credentials, approvals and authorizations that you supply and warrant you are entitled to use, as set out in the MLS®/DDF®/VOW Data Authorization Agreement, which you must accept (including by electronic signature during setup) before listing data is displayed.
8. Custom domains
You may connect a domain name that you own. You are responsible for your domain registration, its renewal, and ensuring your use of the domain complies with your brokerage and regulatory requirements.
9. Acceptable use
You must comply with the Acceptable Use Policy. We may remove content or suspend accounts that violate it.
10. Termination
You may delete your account at any time from your account settings; this unpublishes your sites and deletes your data as described in the Privacy Policy. We may suspend or terminate your access (with notice where practicable) if you materially breach these Terms, if your licensing status lapses, if required by law, or if a listing-data provider requires it. Sections that by their nature should survive termination (including Sections 5, 7, 11, 12 and 13) survive.
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement. MyGTA is not a real estate brokerage and does not provide real estate, legal or compliance advice. Listing data is provided by third parties and may be incomplete, delayed or inaccurate.
12. Limitation of liability
To the maximum extent permitted by law, MyGTA will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues, goodwill or data. MyGTA's total aggregate liability for all claims relating to the Service is limited to the amounts you paid to MyGTA for the Service in the 12 months before the event giving rise to the claim (or CAD $100 if you have paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless MyGTA Inc., its directors, officers, employees and agents from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your content, your use of the Service, your breach of these Terms, or your use or display of MLS®, DDF® or VOW data.
14. Changes to these Terms
We may update these Terms from time to time. If a change is material we will give you reasonable notice (for example by email or an in-product notice). Continued use of the Service after the change takes effect constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. The courts located in Toronto, Ontario have exclusive jurisdiction over disputes arising out of these Terms, and each party attorns to their jurisdiction.
